Children

Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent. Kids, please, be sure to ask your parents for permission before you send any information about yourself to us or anyone else online or over the Internet.

Prohibited uses

You agree not to use the Hero Mag Network (including, without limitation, any User Publication, User Feedback, or other information or data you may obtain through your use of the Hero Mag Network): (a) in a manner that violates any local, state, national, foreign, or international statute, regulation, rule, order, treaty, or other law (each a “Law”); (b) to stalk, harass, or harm another individual; (c) to impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity; or (d) to interfere with or disrupt the Hero Mag Network or servers or networks connected to the Hero Mag Network. You further agree not to: (e) use any data mining, robots, or similar data gathering or extraction methods in connection with the Hero Mag Network; or (f) attempt to gain unauthorized access to any portion of the Hero Mag Network or any other accounts, computer systems, or networks connected to the Hero Mag Network, whether through hacking, password mining, or any other means.

Trademarks

Hero Mag(s), and any other product or service name or slogan or logo contained in the Hero Mag Network are trademarks of Hero Mag and its suppliers or licensors and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Hero Mag or the applicable trademark holder. Ownership of all such trademarks and the goodwill associated therewith remains with Hero Mag or the applicable trademark holder. You may not use any metatags or any other “hidden text” utilizing any name, trademark, or product or service name of Hero Mag without Hero Mag’s prior written permission. In addition, the look and feel of the Site (including all page headers, custom graphics, button icons, and scripts) is the service mark, trademark, and/or trade dress of Hero Mag and may not be copied, imitated, or used (in whole or in part) without Hero Mag’s prior written permission. Reference to any products, services, processes, or other information, by trade name, trademark, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by Hero Mag.

Procedure for making claims of infringement

Hero Mag respects the intellectual property rights of others. Accordingly, Hero Mag has a policy of not printing user publications that violate copyright law, suspending access to the Hero Mag Network (or any portion thereof) to any user who uses the Hero Mag Network in violation of copyright law and/or terminating in appropriate circumstances the account of any user who uses the Hero Mag Network in violation of copyright law. Pursuant to Title 17 of the United States Code, Section 512, Hero Mag has implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with such law. If you believe your copyright or other intellectual property right is being infringed by a user of the Hero Mag Network, please provide written notice to the following Hero Mag agent for notice of claims of infringement.

Your written notice must: (a) contain your physical or electronic signature; (b) identify the copyrighted work or other intellectual property alleged to have been infringed; (c) identify the allegedly infringing material in a sufficiently precise manner to allow Hero Mag to locate that material; (d) contain adequate information by which Hero Mag can contact you (including postal address, telephone number, and e-mail address); (e) contain a statement that you have a good faith belief that use of the copyrighted material or other intellectual property is not authorized by the owner, the owner’s agent or the law; (f) contain a statement that the information in the written notice is accurate; and (g) contain a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright or other intellectual property right owner. Please do not send notices or inquiries unrelated to alleged copyright or other intellectual property right infringement to Hero Mag’s designated agent, as they will be deleted upon receipt.

Termination

Hero Mag may terminate, suspend, or modify your registration with, or access to, all or part of the Hero Mag Network, without notice, at any time and for any reason. You may discontinue your participation in and access to the Hero Mag Network at any time. Please contact Hero Mag Customer Service if you wish to close your Hero Mag Network account. If you breach any of these Terms, your authorization to use the Hero Mag Network (including without limitation, permission to access your Hero Mag Network account) automatically terminates and you must immediately destroy any Hero Mag Materials (and any copies thereof) other than any publications you have properly purchased and paid for in accordance with these Terms or which you are otherwise lawfully entitled to retain (provided that you continue to comply with these Terms to the extent applicable to your use of the user publications you have purchased through the Service).

Indemnification

You agree to indemnify, defend, and hold harmless the Hero Mag Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including without limitation, reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your Hero Mag Network account) violation of these Terms. Hero Mag reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with Hero Mag’s defense of such claim.

THE HERO MAG NETWORK IS PROVIDED “AS IS” AND “WITH ALL FAULTS” AND THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE HERO MAG NETWORK IS WITH YOU. SHOULD THE HERO MAG MATERIALS PROVE DEFECTIVE, YOU, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING AND REPAIR. HERO MAG(s) EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THE HERO MAG NETWORK (INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS). WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, HERO MAG MAKES NO WARRANTY THAT THE HERO MAG NETWORK WILL MEET YOUR REQUIREMENTS OR THAT THE HERO MAG NETWORK WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE OR THAT DEFECTS IN THE HERO MAG NETWORK WILL BE CORRECTED. HERO MAG MAKES NO WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE HERO MAG NETWORK OR AS TO THE ACCURACY, RELIABILITY, QUALITY, COMPLETENESS, OR SUITABILITY OF ANY INFORMATION (INCLUDING WITHOUT LIMITATION, USER PUBLICATIONS AND USER FEEDBACK) OBTAINED THROUGH THE HERO MAG NETWORK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU THROUGH THE HERO MAG NETWORK, ITS PARENTS, SUBSIDIARIES, OR OTHER AFFILIATED COMPANIES, OR ITS OR THEIR SUPPLIERS (OR THE RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS OF ANY SUCH ENTITIES) (EACH A “HERO MAG PARTY”) SHALL CREATE ANY WARRANTY. HERO MAG DISCLAIMS ALL EQUITABLE INDEMNITIES.

Limitation of liability

IN NO EVENT WILL ANY OF THE HERO MAG PARTIES BE LIABLE FOR: (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES; OR (B) ANY DAMAGES WHATSOEVER IN EXCESS OF THE PAYMENTS DUE TO YOU UNDER THE PUBLICATION TERMS OR ONE HUNDRED UNITED STATES DOLLARS ($100) (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF REVENUES, LOST PROFITS, LOSS OF GOODWILL, LOSS OF USE, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES), ARISING OUT OF OR IN CONNECTION WITH THE HERO MAG NETWORK (INCLUDING, WITHOUT LIMITATION, USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE HERO MAG NETWORK, INCLUDING WITHOUT LIMITATION, ANY USER PUBLICATIONS AND USER FEEDBACK), WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY AND EVEN IF ANY HERO MAG PARTY HAS BEEN ADVISED (OR SHOULD HAVE KNOWN) OF THE POSSIBILITY OF SUCH DAMAGES.

Exclusions and limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above disclaimers and limitations of liability may not apply to you. To the extent that any Hero Mag Party may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of the relevant Hero Mag Party’s liability shall be the minimum required under such applicable law.
